Court System Failing

A friend and I were discussing how the Court system fails.

Basically its all too complex. The judges dont act like they are from the same society. They are well educated ‘big heads’ who really believe that due to their money and their social standing that they are worthy to determine guilt.

This has always been the problem with the Court system. The rich select the Judges. The Judges are selected from the ranks of the rich. The rich have little understanding or compassion for the poor.

Is that why we need a soliciter to speak for us? Because the Judge doesnt understand our primitive (cash strapped) language?

Is it because ‘the plebs’ are so far beneath them. They must use a go bewteen. (So as not to contaminate themselves futher)

I think it is because they are so ‘inbred’. They have a mental condition. So require crazy proceedures.

Recently, when I appeared in Court, I noticed that the Police officers who ‘determined’ that an offence was made, were absent during the proceedings.

A ‘Police prosecuter’ instead ‘scans over’ the police report and only reads out what he wants to read out.

In my case. The Police prosecuter didnt read the 3 page police report out in court. He only read ‘what he considered’ would show me in the most negative light as possible.

(So whats new about that? - Well nothing really..)

But since the ‘Police prosecuter’ is only skim reading the police report to glean some angle to prosecute with.

Why waste everyones time and money?

Why do you have to travel to the nearest court location to “where” the alleged offence was committed?

This kind of court cannot hear a ‘not guilty’ plea anyway?

Rant: “Waste your time having to go there to plead ‘not guilty’ - So it can then be ‘given’ to the court where you really can plead not guilty?? - This is RED TAPE running wild! - Why cannot you contact the court prior to the court date - Say your going to plead ‘not guilty’ - Get your new court date allocated there and then.. and cut right back on the RED TAPE that pays court staff to sit on their bums all day everyday, double shuffling the papers around”.

Why can’t the court proceedings be heard closer to your home?

Nominate your Court appearance location

I think people should be able to nominate where they want to attend court.

2 choices only.. Go to Court:

  • Suburb/Town where it happened
  • Suburb/Town where you live.

The Police prosecuter that represents the ‘Crown’ (cough) will not know the history of your case. (But he/she may have been influenced by local officers who have a vested interest in the outcome of the court case.)

Under my proposed changes. Being able to ‘Move’ the court appearance location, would hake it much easier on people who are:

  • Loosing their mobility (Drivers licence)
  • on low income (welfare)

Restricting: 'The Old Boys Network'

Under these conditions, you can select if the Police prosecuter will/will not be influenced by his/her mates. (The arresting officer(s))

Police Officers will still be able to ‘call’ the Police prosecuter to make their case for what ‘they’ consider should be emphasised.

The difference being that the Police prosecuter will not have to ‘face’ the arresting officers daily is he/she determines to proceed alternately.

So is likely to act more inline with judicial prudence. lol

Court Outcome


My mess went to Court yesterday..

  • sigh*

It didn’t go well for me.

Plead Guilty

I pleaded guilty. Stood up to give my evidence.

Magistrate stopped me

The Magistrate stopped me. Told me he wouldn’t allow me to plead guilty. based on what I was saying.

Disagree with Police evidence?

Not that I said anything really. I said that I didnt agree with the Police version of events.

I suppose that says it all really?

Gagged in Court

So basically he wouldn’t let me give evidence.

I never got to show the images of the damage the police did to me.

Really 'Told Off'!

He ‘told me off’ profoundly

Made me ‘feel’ like the scum of the earth. (seriously)

$400 Fine

fined me $400 and warned me that this was the second time I had been found guilty of ‘resisting’. Told me that if I appeared in front of another court for a ‘resisting’ offence I would probably go to jail.

  • sigh*

Fearing the Future

So.. What do you think will happen the next time I happen to ‘meet up’ with any of the police involved?

I reckon.. Without any help from myself. I will somehow find myself on a charge of ‘resisting’..

Is it that corrupt?

What do you think? I know it’s that corrupt. This is just another example.

So now I’m looking for a good ‘soliciter’ to do a civil case on the police involved. If a ‘soliciter’ near Mt Gambier would like to share in the spoils..

2009-07-14 Courts

I received an application for Legal Aid today. With 8 days till court. I am yet to apply for Legal Aid.

If I fill out the form tonight. I will take it to Millicent with me on Wednesday and get it sent away.

Because of this, I will probably ask for some more time to arrange legal advise, during my court appearance in Millicent on the 22nd.

I read the application, and realised that there are no real financial exemptions, to aquiring legal aid.

All you really do is agree to a ‘time payment’ system with a Soliciter, who normally only has 5 minutes contact with you just before court.

Basically all you do is line the pockets of the very people who keep the system exactly “the way it is”.

“The way it is” is an impossible maze for those like myself who are not used to dealing with the police or the courts.

Obviously a pleb such as myself cannot afford to fight the police in court.

What makes it harder is:

  • Police refusing to give their operational guidlines.
  • Courts that are geared to only give justice after endless expensive appeals.

The way I see it. They will take as much money from me ‘one way or the other’ as they can.

So. To minimise cost to myself. Best I can do is:

  • turn up
  • plead guilty
  • appologise to police

Try and make it cost me as little as possible.

I really hate rolling over like this. But I can ill afford the alternative.

  1. 1 Comment. # Typical of the jacks.I used to give to the Salvos but no more.After attending a rehab centre in Darwin that’s run by them,never again.My first visit 4 years ago,I had a squashed disc in my back and was not allowed to have the medication that was prescribed by the doctor from Darwin Hospital.The end result,3 months of agony,that need not of been.This time,I had a very large rear tooth removed,no pain killers allowed.I only wanted 1 Panadeine tablet.It wasn’t like I wanted a whole packet!So,fuck the Salvos & fuck the system!‘cause the system stinks.
